Terms of Service

1. Agreement
These Terms govern your access to and use of Tony's DMS ("the Service"). By creating an account or using the Service you agree to these Terms on behalf of your dealership.
2. Accounts
You are responsible for your account, the accuracy of information you provide, keeping credentials secure, and all activity under your users. Notify us promptly of any unauthorized use.
3. Subscription & billing
The Service is offered on a monthly subscription billed in advance through Stripe. Subscriptions renew automatically until cancelled. You can cancel anytime via the billing portal; access continues through the end of the paid period. Fees are non-refundable except where required by law. Taxes may apply.
4. Acceptable use
Do not misuse the Service: no unlawful activity, no attempts to breach security, no reverse engineering, no reselling, and no uploading of content you lack rights to. You are responsible for your data and your end-customers' data you process.
5. Your data
You retain ownership of data you enter. You grant us a limited license to host and process it solely to provide the Service. You are responsible for the legality of data you collect and for honoring your customers' privacy rights.
6. Intellectual property
Tony's DMS and its software, design, and content are owned by us and protected by law. These Terms grant no rights except the limited right to use the Service.
7. Disclaimers
The Service is provided "as is" without warranties of any kind. Outputs (e.g. pricing, gross, aging, pressure, and AI suggestions) are informational aids — you are responsible for business and compliance decisions.
8. Limitation of liability
To the maximum extent permitted by law, Tony's DMS is not liable for indirect or consequential damages, and total liability will not exceed the fees you paid in the 12 months before the claim.
9. Termination
You may stop using the Service at any time. We may suspend or terminate access for breach or non-payment. On termination you may export your data for a reasonable period, after which it may be deleted.
